breaking news out of san jose. where right now, a homicide investigation is underway after officers respond to a suspect barricaded inside a house. good evening everyone. i'm mike mibach and i'm julie julie haener. >> we start with that breaking news in san jose. police say a woman's body has been found inside a home in the area of north 20th and east julian street, near san jose high school. here's a live picture now from the scene. it is the same home where a suspect was barricaded inside for more than two hours. police say it all started around 6:00 tonight when police responded to a report of a possible shooting. i want to show you a video now from earlier this evening. police say the suspect in that reported shooting barricaded themselves inside the home after hours of negotiating. police say the suspect surrendered and was taken into custody shortly after 830 tonight. apparently this is still live pictures now from the scene. once officers went inside

>> every time during the during the holiday period, we try to have all the officers that are available looking for impaired drivers, people that are not driving safely. >> as people hit the road this memorial day, california highway patrol says it's beefing up patrols across the bay area. triple a estimates that nearly 40 million people will use a vehicle to travel this holiday. the chp and local law enforcement encourage drivers to follow traffic laws when behind the wheel. >> it might be legal, but you cannot be driving under the influence of alcohol, marijuana or any other substance. >> san jose police say they responded to a fatal traffic accident on montague expressway and o'toole avenue on monday afternoon, one driver suffered major injuries and another driver was pronounced dead at the scene. police have not said if alcohol or drugs were involved. meanwhile, at the airport in san jose, passengers arriving to the bay area say air travel went as smoothly as could be expected.

francisco's presidio. >> new at ten tonight, dozens of low income seniors are still waiting to go home after a backed up sewage line at their apartment complex prompted an emergency evacuation. it happened sunday morning, causing their building to be temporarily red tagged. ketv news zac sos joins us now. he's in oakley, outside that apartment complex, after hearing from some of the seniors who were evacuated. zach >> and as of this hour, residents in this complex continuing to be housed at several area hotels. this is their building continues to undergo safety checks, and they're hoping a deep clean two. >> i'm just tired because i'm not used to not being at home. this is very upsetting for everyone. >> jackie ryder and around 50 other seniors temporarily being housed at the hampton inn after firefighters discovered this at their apartment complex in oakley. >> i wanted to throw up. i saw the pictures and thought i was going to pass out. it was so

awful, gloria taylor says. >> crews were first called to oak grove senior terrace on sunday morning, and they opened the electrical room and that's where they found it was it was dripping with water, a clogged wastewater line causing sewage to back up into a vacant apartment and overflow, forcing power to the building to be shut down. i mean, and the smell was horrible, the situation prompting an immediate evacuation of the building housing low income seniors. >> i got to go in ten minutes today to pick up stuff. initially, since it was red tagged, we could not go back in. they've been very, very helpful, letting us in this. >> according to residents, not the first time the building has faced maintenance issues. >> they've had mold, real bad mold in an apartment in our building. >> they're slow on repairs. roaches in another building. >> we were in the newspaper for that one. >> for now, the building says it's housing residents at three area hotels, free of charge and providing partial credit towards

their june rent, a $300 cash card and free meals round the clock security services also monitoring their apartments while they're away. in the meantime, volunteers from the community have staged a donation drive. >> everything started pouring in . i mean, even more than what we can use food, pet supplies, waters, clothes, the residents all to grateful but still worried about the state of their building. these seniors deserve better. just because they're low income doesn't mean they need to live in squalor. >> we may be older, but we're not stupid and that's how we're treated. lots of times. >> and in a statement to ktvu oakley, city council member anissa williams saying people will not be moved back in until the city is reassured that the building is safe and sanitary. the mayor and vice mayor have been coordinating with the various donation efforts and ensuring that the people displaced are being cared for and have access to everything

they need. one resident telling me they plan to go to the city council meeting tomorrow to voice their concerns about the state of their building. as for when they might be moved back in, building management says that could happen tomorrow evening or early wednesday. julie >> all right. zac sos reporting live tonight from oakley. zach. thank you. oakland fire crews are still investigating the cause of a four alarm fire at a lumber yard. it broke out at about 8:00 last night at the economy lumber warehouse on high street near interstate eight. 80 crews were able to keep it contained to one building, but the warehouse was destroyed. that fire is now out, but air quality remains a concern in the area. authorities say no one was inside the building at the time of that fire. no injuries have been reported. >> the alameda county board of supervisors will consider whether to place civilian oversight over the sheriff's office. if approved, the oversight board would consist of seven citizens. they could request information and hold

hearings and make recommendations to the board of supervisors. community members have been pushing for some type of oversight for years now. advocates point to the high in-custody death rate at santa rita jail in dublin, which stands at nearly 70 over the past ten years. >> mentally ill having drug addiction being homeless. they are still members of our community and so it's important for us to be participants in being sure that they are protected. >> two points of contention are whether investigators would have to get the green light from the sheriff, and whether the commission would have its own legal counsel. the board of supervisors is scheduled to take up the issue on june 4th. many in the sports world are mourning the death of a basketball icon, basketball hall of famer turned broadcaster bill walton passed away today after battling cancer. >> the san diego native played under legendary coach john wooden at ucla and won two national titles in the nba.

walton was the 1978 mvp and won a title with the portland trail blazers. walton then went on to a celebrated career as a sportscaster. after retiring from the nba. >> there was a bill walton school of broadcasting. they would probably first day they'd just hand you a big megaphone and something to make you happy and say, until you just go for it. you know, bill, there was no rules for bill in broadcasting. he just he just it's like if they stopped paying bill, they said we can't pay anymore. he'd say, that's okay, i'll do it for free. he just loved doing it, man. his, his he was so passionate about. he loved the game so much. >> warriors head coach steve kerr, paying tribute to walton in a statement saying, quote, bill walton was a legendary player, a hilarious, colorful broadcaster and most of all, a wonderful person. his incredible energy, passion, love and zest for life was never turned off. our hearts are broken today as we mourn bill's passing and

next monday. tickets go on sale tomorrow. san francisco's annual documentary film festival gets underway this week. organizers say there are 90 films in this year's sf doc fest, covering a wide range of subjects from the migrant crisis to a profile of artist thomas kinkade. the movies are being shown at the roxy theater or online. that festival runs through june 9th. >> more than 1200 volunteers are working on san jose's newest piece of public art. it's called threads woven, and city leaders hope the completed artwork will draw people to the downtown area. hundreds of volunteers are scheduled to paint the massive mural near san pedro square each day this week. it was designed by bay area artist jimi paints, who said the inspiration was a serape blanket and the diversity of san jose. >> this isn't about me. this is about the community, the people. and you know, the street is now pedestrian only, so that just makes it even more theirs. >> it takes the block parties

is made by a south bay couple fighting what they call squalid conditions at their apartment, but the landlord's family says this is an example of squatters taking advantage of an elderly woman who was just trying to help. ktvu south bay reporter jesse gary tells us the city of san jose is now investigating the claims multiple times a week. >> demetrio lopez martinez spends his days struggling to maneuver his wheelchair around valley medical center in san jose. some days he comes for kidney dialysis, others to see a chiropractor. whatever the reason, martinez, who only

speaks spanish, never goes home. in between appointments. >> the problems started becoming noticeable right after we moved in. >> cell phone video gives a glimpse of what demetrio and his wife, teresa elena alejandre say they've dealt with since moving into this studio apartment on florida avenue in december 2020. two roaches under the cabinets, dog feces outside their kitchen window, no stove and no smoke or natural gas detectors either. all this renting for $1,650 a month. >> we rented this because we frankly didn't have another option on where to live, so that's why we rented it. >> they're low income, they're immigrants. they take what they can get. >> san francisco based attorney steven mcdonald is suing the property owner on behalf of demetrio and his wife. mcdonald says the landlord, ignacio marmolejo, illegally altered her home to include a studio apartment, then threatened the couple with eviction for

reporting various problems. >> it's very common for a landlord who owns a single family home to try to augment their income by creating a separate unit when nobody's looking, it's i think it's ridiculous. >> a single divorced woman, a senior citizen living on a fixed income that's dealing with squatters. basically, that's that's exactly what it is. >> by phone from san diego, alex marmolejo concedes his mother didn't get the required permits before creating the apartment. but he says these pictures prove it was in pristine condition. when demetrio and his wife moved in. he says they're the ones that have created unsanitary conditions, then refused to leave and reported ignacio to the city as retribution. >> they never had an issue. everything was great for like the entire year that they lived there. no complaints from them about nothing. they never told us until the day when the city called my mom. >> the san jose building and code enforcement department says a code enforcement case was opened at the beginning of this year after the office received a

complaint. the inspector found the unit is an addition to the home legally constructed in 1985. however, it was modified without permits to include a full kitchen, bathroom and bedroom with electrical and plumbing code. enforcement has ordered removing the apartment modifications or submitting applications for permits and that, according to mcdonald, is why the couple has no stove, the marmolejo family says. and the city confirms there have been no fines for unlivable conditions at the apartment. the couple is still in the apartment as the lawsuit moves forward, the marmolejo family says they believe the entire process is tilted in favor of the renters. they say they're having a hard time hiring a lawyer to defend them. in this case, outside san jose city hall. jesse gary, ktvu, fox two news tomorrow, lawyers for paul pelosi is convicted attacker will argue his looming trial in san francisco court should be thrown out. >> the san francisco district attorney has filed several charges against david depape for

came up yesterday and then again today with numbers and back into the mid 80s or low 80s in the warmest spots. these are the numbers from today. highs tomorrow will be about the same. it's warm inland. it's cool at the coast. that's what you expect this time of year. that's what we're going to get. there's fog out there right now and you can see the fog. you can't really see it, but you can imagine it's there. it's well up over the top of the control tower at sfo. and that fog is going to push into your neighborhood tonight, especially if you're out in the tri-valley area. it's going to funnel right down through the livermore valley, kind of move in there. it'll be in the north bay as well, but not as extensively. at least that's the plan in this fog, in the fluctuations of the fog, night and morning and day to day are going to be is going to be the determinant of the mechanism that gives us warmer air, cooler, warmer. i know it's pretty. yeah i know duh. but what i'm saying over the course of five or 4 or 5 days, it's just going to keep doing this. so we're going to go up one day down one day up one day down one day. just very subtle changes. a couple of degrees here, a couple

of degrees there. the bay area, the most of us this entire week are going to be in the mid probably upper 60s to mid 70s. that's redwood city. san jose area is right around the bay. and if you get in, go east a little bit over the hill, you're going to get yourself some warmth. you'll find some mid and low 80s all week. and then along the coast it's 50s and low 60s. there's the fog forecast for tomorrow morning. it's gone. and then the fog kind of goes away on in the north bay on wednesday morning and then is gone by wednesday afternoon. stays gone on thursday. that's why wednesday thursday appear to be the warmer days in the inland bay valleys, with temperatures coming up a few degrees. but again, these are subtle bumps and highs and lows. so tomorrow's highs are going to cool just a tad inland and cool a little bit. maybe along the coast a degree or two or up a degree or two along the coast, but just up and down just a little bit. the jet stream is close enough to us that it's allowing for these perturbations to kind of drift by to the north. and when they do next, actually it's 11. i'll show you
